Contract terms and conditions
1- PRIOR OBLIGATIONS
This document sets out the general conditions governing the sale of products and services (hereinafter, the "General Terms and Conditions of Contract") by Laboratorios Calduch (hereinafter, "Laboratorios Calduch") through this website (hereinafter, the "Website" or the "Site").
By using the Website, and by purchasing products and/or services through it, you agree to be bound by these General Terms and Conditions of Contract, as well as by the Terms of Use of the Website, and by our Privacy Policy and Cookies Policy (hereinafter, collectively referred to as the "Terms and Policies"), all of which are set out on the Website.
These Terms and Conditions may be modified at any time, and it is the buyer's responsibility to review them periodically, as well as each time products and/or services are purchased. The Terms and Conditions in effect at the time of use of the Website or at the time the contract is entered into will be those applicable to it.
The language in which the contracting procedure will be processed and in which this Contract is formalized will be, unless otherwise indicated, Spanish.
2.- IDENTIFICATION OF THE CONTRACTING PARTIES
These General Terms and Conditions for the products and services offered on the Website are agreed upon:
On the one hand, by Laboratorios Calduch, SL, with CIF B44503464 and address located at Calle Enmedio, 13 – 12001 Castellón de la Plana (Castellón).
And, on the other hand, by the Customer of the products and/or services offered by Laboratorios Calduch (hereinafter, the "Customer" or the "Buyer") whose personal data are those that he has provided on the Website and, in particular, through the form that Laboratorios Calduch has made available to him, an essential requirement to be able to make any purchase.
3.- USER STATUS
To become a Client, you must be of legal age and have the legal capacity to enter into a contract. Upon becoming a Client, you agree to the following:
- Provide only truthful information in all actions related to Laboratorios Calduch. If the Client provides any false, inaccurate, or incomplete information, or if Laboratorios Calduch has reasonable grounds to doubt the truthfulness, accuracy, or completeness of this information, Laboratorios Calduch may deny the Client access to and/or use of the Website or any of its content, Products, and/or services, now or in the future.
- Diligently safeguard your username and password and assume responsibility for any damages that may result from misuse caused by a lack of this diligence.
Laboratorios Calduch will not be liable for any consequences arising from the failure to comply with these commitments.
4. OBJECT AND NATURE OF THE CONTRACT
Laboratorios Calduch operates a website whose business consists of offering and selling a wide variety of parapharmaceutical products to the Customer (hereinafter, the "Products"). The sale of the Products through the website is intended exclusively for end consumers, in accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
In accordance with the provisions of Law 29/2006, of July 26, on guarantees and rational use of medicines and health products, it is stated that Laboratorios Calduch will not carry out through this Website the promotion or marketing of medicines and/or products that require medical prescription, these being, solely and exclusively, dispensed by legally constituted pharmacies.
5. PURCHASING SYSTEM
5.1 The Products
Laboratorios Calduch informs you that the Products offered on the Website are detailed in each section within the Website. Laboratorios Calduch strives to ensure that the Product photos clearly identify them, but cannot be held responsible for how the Customer may interpret them.
Once you become a customer, if you wish to purchase one of our products, you will need to add it to your cart, complete the order form that will appear, and confirm your order. Confirming your order implies that you are aware of and expressly accept the established general terms and conditions of sale and that you become a customer of Laboratorios Calduch, the company from which you are making your purchase.
To place an order, you must be a Laboratorios or Calduch user. User status is acquired by completing the electronic form or the specific brochure for this purpose, which you will find on the Laboratorios or Calduch website.
5.2 Product Prices and Applicable Taxes.
All Product prices are indicated in euros (€) and correspond to the unit price of each product including Value Added Tax (VAT).
In accordance with Article 68 of Law 37/1992 of 28 December, on Value Added Tax, the delivery of the goods shall be deemed to take place within the territory where Spanish VAT applies. The applicable VAT rate shall be the legally established rate in force at any given time, depending on the specific item in question.
The prices and offers shown are valid exclusively for online orders placed with Laboratorios Calduch and only at the time you view them, as they are subject to change. The price you will be charged for your purchase will correspond to the product(s) you select at the time of order confirmation. Prices on the website and at Laboratorios Calduch's physical stores are the same, but exclusive, limited-time promotions may be offered through the website under certain conditions, applicable only to products sold through the website.
5.3 Purchase Confirmation
The purchase will be considered complete once the Customer presses the "Confirm/Pay/OK" button on the corresponding payment gateway, it being understood that following all the phases of the electronic contracting procedure and including all the requested data, together with the final express acceptance of these terms, constitutes a clear and direct manifestation of the final Customer's will to accept these General Contracting Conditions.
Within twenty-four hours of your purchase, Laboratorios Calduch will send you the receipt by email; if you do not agree with the information contained in this receipt, you may request its modification.
Unless proven otherwise, the recorded data constitutes proof of the transactions carried out between you and Laboratorios Calduch, adding your data to our customer file and archiving the electronic document in which the contract is formalized, which will be accessible to you.
5.4 Terms and conditions of payment
Payment can be made through the following methods:
a) Bank cardWe accept payments with credit and debit cards (Visa, Mastercard, Maestro).
b) Bizum: Making the instant payment through the Bizum platform.
To make the payment, the Customer will be redirected to the secure Redsys payment gateway, where they can select their preferred payment method and enter the necessary information to complete the transaction. This gateway complies with the highest security standards (PCI-DSS) and data encryption.
Laboratorios Calduch will consider the purchase effective once it has received the corresponding payment authorization confirmation from the bank or the Bizum system. From that moment, the order preparation and shipping time will begin.
If the payment process is interrupted for any reason (transaction rejection, incorrect data, insufficient funds, cancellation by the Customer, etc.) or if the amount paid does not reach the amount corresponding to the order placed (including applicable shipping and handling costs), Laboratorios Calduch will automatically suspend the purchase process and will not proceed to ship the Products, informing the Customer of this circumstance.
In case of any issues with payment, the Customer can contact our customer service department to resolve any doubts or try to place the order again.
5.5 Delivery of Products
- Product Availability
All product orders are subject to availability. Therefore, if there are any difficulties in supplying products or if items are out of stock, Laboratorios Calduch will contact the customer to inform them of the new delivery date. The customer may then choose to keep the order or receive a full refund.
If an order includes several Products and one of them is not in stock, Laboratorios Calduch will contact the Customer to arrange to ship the order in a single shipment or in separate shipments.
- Product Delivery Times
Without prejudice to the provisions of the preceding clause regarding the availability of the Products, and unless extraordinary circumstances of supply shortage and/or Force Majeure (as described below) arise that could not be foreseen, Laboratorios Calduch undertakes to make the order available to the Customer at their address within a maximum period of 2-3 business days. Upon delivery, the Customer must sign the delivery note confirming receipt and acceptance of the order.
The delivery period will begin to run from the moment the payment has been received from the Customer and, in any case, the delivery of the Products will be made before thirty (30) calendar days from the date of the order.
- Delivery conditions for Products to your home
Shipping and handling costs, which are not included in the price of the pads, will be displayed before you finalize your purchase, as they vary depending on the shipping address. If the order weighs more than 2kg, Laboratorios Calduch will contact the buyer at the email address provided during checkout to inform them of the costs. In case of disagreement, the order may be canceled without any charge. We ship to mainland Spain.
If an order is returned by the courier company to Laboratorios Calduch due to causes that may be attributable to you (such as negligence in receiving it or an incorrect address), it will not be sent to you again until you pay for a new delivery, for which you will have to contact Laboratorios Calduch.
5.6 Cancellation of Product Purchase
Laboratorios Calduch reserves the right to remove any Products from the Website at any time and to remove or modify any material or content on it.
Likewise, Laboratorios Calduch undertakes to do everything necessary for the processing of orders without having to refuse to send the order even after sending the confirmation due to exceptional circumstances.
In any case, Laboratorios Calduch will not be liable to you or any third party for removing any Product from the Website, removing or modifying any material or content from the Website or for cancelling orders even after the purchase confirmation has been sent, and must always duly inform the Customer.
5.7 Shipping and delivery times Orders placed at Laboratorios Calduch can be shipped to any point on the peninsula, but in no case to post office boxes.
Your purchase will need to be delivered within the timeframe that you will be informed of when you place your order.
6.- RIGHT OF WITHDRAWAL
In any case, to exercise the right of withdrawal it is essential to do so by sending an email to the following address of Laboratorios Calduch: info@laboratorioscalduch.com.
In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Laboratorios Calduch informs the Customer that they may exercise their right of withdrawal within a maximum period of 14 calendar days from the moment of receipt of the Product.
Regarding the withdrawal process, the Customer must comply with the following additional conditions:
- The Customer is obliged to send the packaged Product, with its corresponding seal intact and without signs of having been handled or opened, directly to the address that will be provided once the request for the right of withdrawal has been sent, no later than 14 calendar days from the date on which he communicates his decision to withdraw.
- When Laboratorios Calduch receives the Product(s) and verifies that it meets the conditions indicated above, the amount paid by the Customer in the purchase process will be refunded, using the same payment method used by the Customer in the initial transaction, and within a maximum period of 14 days from when Laboratorios Calduch has been informed of the decision to withdraw from the Contract.
- The direct costs of the return will be borne by the Customer except in cases of error in the shipment, damaged order or product in bad condition, in which the return costs will be assumed by Laboratorios Calduch, provided that the return has been made in accordance with the return instructions given by Laboratorios Calduch.
In the event that Laboratorios Calduch detects any kind of tampering or damage to the returned product, it reserves the right to send the product back to the Customer by mail with cash on delivery, with the latter assuming the corresponding shipping costs.
Regarding Products that require opening to determine their proper functioning, Laboratorios Calduch requires that the specific Product be in perfect condition with all its elements, accessories and packaging, and no return can be processed if these requirements are not met.
In accordance with the provisions of Article 103. c) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, it will not be possible to exercise the right of withdrawal in those cases in which Products made according to the consumer's specifications or clearly personalized are acquired, or which, by their nature, cannot be returned or may deteriorate or expire quickly.
7. GUARANTEES
The products offered by Laboratorios and Calduch are genuine brand-name products, with manufacturer's warranty and no defects; all of them come with the legally established warranty periods. Given that the vast majority of products sold are perishable and consumable, the minimum legally established warranty period will be that of the product itself. In any case, the customer must inform Laboratorios and Calduch of any lack of conformity within two months of becoming aware of it.
However, given the characteristics of the commercial Products, the Customer must bear in mind that these have their respective expiration and best before dates, guaranteeing in all cases that, at the time of marketing, the Products have a sufficient and reasonable period for their consumption.
In the event that the purchased Product has any kind of defect, the Customer may contact Laboratorios Calduch immediately to be informed of the return procedure. Upon receipt of the Product by Laboratorios Calduch, after verifying any defects, all amounts paid will be refunded.
The return of Products in case of damage will in no case entail a direct cost for the customer.
8. INCIDENTS
In the event that the Customer receives any defective product or has not received any of the requested Products, the Customer must inform Laboratorios Calduch immediately through the means indicated in section ten.
Laboratorios Calduch will proceed to resolve the incident as soon as possible and at its own expense, provided that the incident is attributable to Laboratorios Calduch.
9. FORCE MAJEURE
For the purposes of these General Terms and Conditions of Contract, force majeure shall be understood to include, but not limited to, (i) events that are impossible to foresee or that, if foreseen, are unavoidable, (ii) damages caused by third parties unrelated to Laboratorios Calduch that affect the quality of the services provided by the latter and that are not attributable to it; (iii) strikes or labor disputes; (iv) epidemics or pandemics; among others.

11.- PARTIAL NULLITY
If any of these General Terms and Conditions of Contract are declared null and void by a final decision of the judicial authority or any other competent authority, the remaining terms and conditions will remain in force, without being affected by said declaration of nullity.
12. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions of Contract are subject to Spanish law and to the Courts and Tribunals of the domicile of Laboratorios Calduch or of the domicile of the Client, at the latter's choice in accordance with article 52 of Law 1/2000, of January 7, on Civil Procedure.
This merchant agrees not to permit any transaction that is illegal or that is considered by the credit card brands or the acquiring bank to be potentially damaging to their goodwill or to negatively impact them. The following activities are prohibited under the card brand programs: the sale or offering of any product or service that does not fully comply with all laws applicable to the buyer, issuing bank, merchant, cardholder, or cards.
In addition, the following activities are also explicitly prohibited:
- Selling prescription drugs or drugs subject to medical prescription.
